COPYRIGHT AND NEIGHBOURING RIGHTS ACT (AS AMENDED) ACT To provide for copyright and neighbouring rights; to repeal the Copyright Act [Chapter 26:01]; and to provide for matters connected with or incidental to the foregoing. ENACTED by the President and the Parliament of Zimbabwe. [Date of commencement: Not yet in force.] PART I PRELIMINARY 1 Short title and date of commencement (1) This Act may be cited as the Copyright and Neighbouring Rights Act [Chapter 26:05]. (2) This Act shall come into operation on a date to be fixed by the President by statutory instrument:2 Provided that the President may fix different dates of commencement for different provisions of this Act. 2 Interpretation In this Act— “adaptation”, in relation to— (a) a literary work, includes any of the following— (i) a translation of the work; (ii) a version of the work in which the story or action is conveyed wholly or mainly by means of pictures in a form suitable for reproduction in a book or in a newspaper, magazine or similar periodical; (iii) in the case of a dramatic work, a version of the work, whether in its original language or in a different language, in which it is converted into a non-dramatic work; (iv) in the case of a non-dramatic work, a version of the work, whether in its original language or in a different language, in which it is converted into a dramatic work; (v) in the case of a computer program⎯ A. a version of the program in a programming language, code or notation different from that of the original program; B. a fixation of the program in or on a medium different from the medium of fixation of the original program; 2 Not in force as at 16th April, 2004 (i.e., not yet brought into operation by statutory instrument).
