CLASS ACTIONS ACT [CHAPTER 8:17] as at 26 January 2017 PART IV GENERAL 22 Act not to derogate from other laws This Act shall be construed as additional to, and not as derogating from, any other law under which a person may bring any proceedings on behalf of another. 23 Act to apply to previous causes of action Subject to the Prescription Act [Chapter 8:11], this Act shall apply in respect of any cause of action which may have existed but had not been enforced before the date of commencement of this Act. 24 Class action proceedings before the Supreme Court The Supreme Court shall have the same powers as the High Court under Part II of this Act in relation to any application in terms of section 24 of the Constitution or any other constitutional question, and the provisions of Part II shall apply, mutatis mutandis, to the institution and prosecution of any class action in the Supreme Court under this Act. 5 5 Section inserted by s. 13 of Act 14/2002 (with effect from 24 January 2003). -9-
