No. 12/2017 LAJ'.'D COMMISSION Cap. 20:29 may by notice in wtiting, direct the Commission to undertake an investigation of any farm within any area to ascertain whether or not the farm is being so occupied. (2) On receipt of a notice in tem1s of subsection (1) the Commission shall cany out as expeditiously as possible any investigation directed by the notice and shall report to the Minister thereon. 32 Minister may give orders to lawful holders or occupiers of farms (1) Subject to section 34, after consideting any repmt in terms of section 31, the Minister may, by order in writing served on the holder or occupier of the farm, direct the holder or occupier- (a) not to permit any more than such number of persons as is specified in the order to occupy the farm; or (b) to permit only such class of persons as is specified in the order to occupy the fam1; or (c) to pem1it only such activities or class of activities as is specified in the order to be conducted on the farm; and may in such order direct the holder or occupier to take measures as may be specified in the order to ensure compliance therewith. (2) Any holder or occupier of a fmm who contravenes or fails to comply with an order served on him or her in terms of subsection (1) shall be guilty of an offence and liable to a fine not exceeding level nine or to imprisonment for a petiod not exceeding two years or to both such fine and such imptisonment. 33 Minister may give orders to other occupiers of farms (1) Subject to section 34, where the Minister makes an order in terms of section 32 he or she may, in addition, by order in the Gazette and in a newspaper circulating in the district where the fmm concerned is situated, direct such persons or classes of persons as are specified or desctibed in the order to cease to occupy the farm concerned within such period as may be specified in the order and that- (a) no more than such number of persons shall occupy the fmm; or (b) no persons other than such class as is specified in the order shall occupy the farm; or (c) no activities or class of activities other than those specified in the order shall be conducted on the fann; until such time as the order is revoked or vatied in tenns of section 35. (2) Any person who contravenes or fails to comply with an order in terms of subsection ( 1) shall be guilty of an offence and liable to a fine not exceeding level six or to imprisonment for a petiod not exceeding one year or to both such fine and such imprisonment. 34 Minister to give notice of proposal to make order (1) Before making an order in terms of section 32 or 33 the Minister shall give notice of his or her intention to make such order(a) to the lawful holder or occupier of the fatm concerned; and (b) to the persons or classes of persons who will be required to cease occupying the farm concemed or cease conducting the prohibited activities, as the case may be; 220
