subscribing before the Chief Justice or other judge of the Supreme Court or the High
Court the oaths of loyalty and office in the forms set out in Schedule 1.”.
(2) The amendments made by subsection (1) apply to the President in office on the date
of commencement of this Act, notwithstanding anything contained in section 29 before its
amendment by this Act.

Amendment of section 29 of Constitution
(1) Section 29 (“Term of office of President”) of the Constitution is amended by the
repeal of subsection (1) and the substitution of the following subsection—
“(1) The term of office of the President shall be a period of five years concurrent
with the life of Parliament referred to in section 63(4), or⎯
(a) a lesser period where the President earlier dissolves Parliament in terms of
section 63(2), or the President is elected pursuant to section 28(3)(b); or
(b) a longer period where the life of Parliament referred to in section 63(4) is
extended under section 63(5) or (6);
in which event term of office of the President shall terminate on the expiration of such
lesser or longer period, as the case may be:
Provided that the President shall continue in office until the person elected as
President at the next election of President enters office.”.
(2) The amendments made by subsection (1) apply to any President elected after the date
of commencement of this Act.

Amendment of section 31H of Constitution
Section 31H (“Executive functions of President”)(5)(c2) of the Constitution is amended
by the deletion of “section 38(1)(d)” and the substitution of “section 34(1)(e)”.

Amendment of section 31J of Constitution
Section 31J (“Public emergencies”) of the Constitution is amended—
(a) in subsection (3)—
(i) in paragraph (a) by the deletion of “Parliament” wherever it occurs and the
substitution of “the House of Assembly”;
(ii) in the proviso by the deletion of “Parliament” and the substitution of “the
House of Assembly”;
(b) in subsection (4) by the deletion of “Parliament” and the substitution of “the House
of Assembly”;
(c) in subsection (5)—
(i) by the deletion of “Parliament” where it occurs for the first time and the
substitution of “the House of Assembly”;
(ii) in paragraph (b) by the deletion of “Parliament” and the substitution of “the
House of Assembly”;
(d) in subsection (6) by the deletion of “Parliament” and the substitution of “the House
of Assembly”;
