National Prosecuting Authority Act, 2014 [Chapter 7:20] 13 No. 5/ 2014 Publication of general principles pursuant to section 260(2) of the Constitution The Prosecutor-General shall— (a) not less than six months after the enactment of this Act, the case of the first Prosecutor-General; or (b) not less six months after his or her appointment; publish by General Notice in the Gazette and in such other media as he or she considers will bring such principles to public notice the general principles by which he or she decides whether and how to institute and conduct criminal proceedings. PART IV ADMINISTRATION OF NATIONAL PROSECUTING AUTHORITY 14 Policy directions concerning Board’s functions Subject to the Constitution and this Act, the Minister may give the Board such directions of a general character relating to the policy which the Board is to observe in the exercise of its functions, as the Minister considers to be requisite in the public interest: 15 Department of Administration (1) There shall be a department of the Authority, whose staff shall be appointed by the Board in consultation with the Minister, known as the Department of Administration, which shall be responsible for― (a) managing the administrative, human resource management and financial affairs of the Authority and implementing the decisions of the Board; and (b) providing technical advice and support to the Board; and (c) formulating administrative rules, guidelines and procedures to facilitate the achievement of the mission of the Authority; and (d) exercising any other functions that may be imposed or conferred upon it by this Act or any other enactment. (2) The Department of Administration shall be controlled by the Director for Administration (subject to the general control of the Board and to any specific directions given to him or her by the Board) and staffed by such persons as the Board may think necessary to ensure that the Department is able to discharge its functions. (3) The Director for Administration shall― (a) be the secretary of the Board; and (b) report to the Secretary responsible for Justice, Legal and Parliamentary Affairs. 16 Departments and classification of members of Authority (1) In addition to the Department of Administration, the Authority shall have such departments and sub-departments as the Board may establish from time to time, each headed by an member of such grade and designation as the Board shall determine. - 10 -
