(2) Where. in the exercise of the power under
subsedion (I). the Director or an employee. inspector
or agent oft he l 'nit requests infonnation from a person
referred to in subsection ( 1). the information shall be
providt.~d within such reasonable time and in such
manner as may he specified in w1iting by the Director
or by tht~ employee. inspector or agent concerned.
( 3) This section shall not be construed as·--
(a)
limiting the powers of inspectors
under sc~,:tion 9 ("Inspectors and their
powers"); or
(h)
precluding the l·nit from obtaining
information from any other person or
entity. whether in ac~.:on.lance with the
Access to Information ami Pmtcdion of
Privacy Act [Ciwprer 10:271 or otherwise.

require a legal practitioner to disclose any pri\'ileged
communication made to him or her in that capacit)
11 Confidentiality
(I) Any information reJX)rted to the t· nit or
gathered or discovered by any employee, inspector
or agent of the l 'nit in the course of cxcrl~ising his
or her functions under this Act shall he confidential
to the t'nit, and no person shall disclose any such
information to any other person or body except-
(a)
in the course of exercising his or her
functions under this Act; or
(h)
to a judicial officer for the purposes of
any legal proceedings under this Act; or
in accordance with the order of any court;
or
(c)
(d)
for the purposes of any prosecution or
criminal proceedings;
or where the disclosure is authorised or required by
or under this Act or any other law.
(2) Any officer, employee, inspector or agent
of the Fnit who discloses any infonnation referred to
in subsection ( l) otherwise than in accordance with
that subsection, or makes usc of it for personal gain,
shall be guilty of an offence and liable to a line not
exceeding level eight or to imprisonment f()r a pe1iod
not exceeding three years. or to both such line and
such imprisonment.
(3) The Director shall ensure that the l:nit
maintains adequate systems and procedures to
maintain the confidentiality of information rcfen·ed
to in subsection ( 1).
