Chapter 17:11 Older Persons Act as at 15th September 2016 Act 1/2012 ACT To provide for the well-being of older persons; to provide for the appointment of a Director for Older Persons Affairs, the establishment of an Older Persons Board; to create an Older Persons Fund; and to provide for matters connected therewith, or incidental thereto. ENACTED by the President and Parliament of Zimbabwe. PART 1 PRELIMINARY 1 Short title and date of commencement (1) This Act may be cited as the Older Persons Act, 2011. (2) This Act shall come into operation on a date to be fixed by the President by statutory instrument. 2 Interpretation In this Act⎯ “adjustment order” means an adjustment order served in terms of section 11; “Board” means Older Persons Board established in terms of section 4; “destitute or indigent”, in relation to an older or other person, has the meaning given to that term by the Social Welfare Assistance Act [Chapter 17:05]; “Director” means the Director of Older Persons Affairs referred in section 3; “home” means any premises specifically provided for the residence of older persons; “Minister” means the Minister of Labour and Social Services or any other Minister to whom the President may assign the administration of this Act; “older person” means a citizen of Zimbabwe aged sixty-five years or above, who is ordinarily resident therein; “ordinarily resident” means, in relation to an older person, an older person who resides in Zimbabwe for not less than one hundred and eighty-one days in any calendar year. PART II OLDER PERSONS BOARD 3 Director for Older Persons Affairs (1). There shall be a Director for Older Persons Affairs who shall be the person for the time being, holding the office of the Director of Social Welfare or lawfully acting in that capacity.
