It must be recognised that legislation alone cannot eliminate child marriage: the
underlying causes of child marriage such as poverty need to be remedied. The
cost of schooling is one such area which the Government should examine in
order to extend the reach of free education as far as possible. Another
contributing factor is that of cultural and religious practices. The Government
and civil society organizations need to work together spread awareness of the
adverse impact child marriage has on girls.
Teen Pregnancy
Pregnant girls are also subjected to prejudicial treatment in schools, often being
forced to leave as a result of their falling pregnant. The Constitution in section
27(2) provides that:
“The State must take measures to ensure that girls are afforded the same
opportunities as boys to obtain education at all levels.”
The unequal treatment of pregnant girls in schools runs contrary to section
27(2) of the Constitution and this injustice must be publicized and redressed.
