(e) property which has been collected for the purpose of providing support to an
organised criminal group or funding a serious offence;
“terrorist” means any individual who—
(a) commits or attempts to commit, terrorist acts by any means, directly or indirectly,
unlawfully and wilfully;
(b) participates as an accomplice in terrorist acts;
(c) organises or directs others to commit terrorist acts; or
(d) contributes to the commission of terrorist acts by a group of persons acting with a
common purpose where the contribution is made intentionally and with the aim of
furthering the terrorist act or with the knowledge of the intention of the group to
commit a terrorist act.
“terrorist act” means—
(a) an act of insurgency, banditry, sabotage or terrorism as defined in section 19 of
the Criminal Law Code; or
(b) any offence specified in the Suppression of Foreign and International Terrorism
Act [Chapter 11:21] (No. 5 of 2007); or
(c) an act which constitutes an offence within the scope of, and as defined in one of
the international agreements specified in the Second Schedule; or
(d) any other act intended to cause death or serious bodily injury to a civilian, or to
any other person not taking an active part in the hostilities in a situation of armed
conflict, when the purpose of such act, by its nature or context, is to intimidate a
population, or to compel a Government or an international organisation to do or to
abstain from doing any act;
“terrorist financing” and “terrorist financing offence” means any offence referred to in
section 9;
“terrorist organisation” means any group of terrorists that—
(a) commits, or attempts to commit, terrorist acts by any means, directly or indirectly,
unlawfully and wilfully; or
(b) participates as an accomplice in terrorist acts; or
(c) organises or directs others to commit terrorist acts; or
(d) contributes to the commission of terrorist acts by a group of persons acting with a
common purpose where the contribution is made intentionally and with the aim of
furthering the terrorist act or with the knowledge of the intention of the group to
commit a terrorist act;
“terrorist property” means—
(a) the proceeds from or instrumentalities of the commission of a terrorist act; or
(b) property which has been, is being, or is intended to be used to commit a terrorist
act; or
(c) property which has been, is being, or is intended to be used by a terrorist
organisation; or
(d) property owned or controlled by, or on behalf of, a terrorist organisation; or
(e) property which has been collected for the purpose of providing support to a
terrorist organisation or funding a terrorist act.
“transaction” has the meaning given to it in section 13;
