The focal idea is to promote the well being and best interests of the child as well as their reintegration into
the society. Juveniles are supposed to enjoy the rights that every child will be enjoying besides the fact that
they are in contact with the law.
Corporal punishment has been held to be a violation of Article 37(a) of the CRC which prohibits all forms of
cruel, inhuman and degrading treatment or punishment.54 International human rights law also outlaws the
death penalty in respect of juvenile offenders.
2.12.
CONCLUSION
The juvenile justice should embody all the above in order to achieve rehabilitation of the juvenile offenders.
This should start from the national legal provisions to the institutions that administer the law. The next
chapter will therefore considers the legal position in Zimbabwe as well as assess its practical implications to
the rights of children in contact with the law.
