be monitored during and after the election period. For all the reasons above, I contend that the Applicants are interested parties within the context of the requirements for a declaratory order, and may properly bring the present application. THE APPLICANTS’ INTEREST IS BASED ON THE RIGHT TO A FREE AND FAIR ELECTION IN TERMS OF SECTION 67 OF THE CONSTITUTION 18. Having established that the Applicants have a direct and substantial interest in the matter, I further contend that the Applicants’ interest arises from the right to a free and fair elections as guaranteed through section 67 (1) (a) of the Constitution. This is a constitutional right which is guaranteed to every Zimbabwean citizen, including myself and the trustees of the Second Applicant as well as its beneficiaries. 19. I further contend that transparency in the processes and personnel of the First Respondent in conducting an election is a key safeguard to the realisation of the right to a free and fair election under the Constitution. Without such information, the right to a free and fair election as guaranteed by the Constitution would be meaningless. In that respect, the Applicants’ interest in the orders sought is clearly based on rights which are guaranteed in the 9
