DISPOSITION

I am satisfied that both the arbitrator and the court a quo were wrong in finding that the
respondent was unlawfully dismissed. The appeal must therefore succeed with costs.

It is accordingly ordered as follows:

The appeal succeeds with costs.
2.
The judgment of the court a quo is set aside and in its place the following
substituted:“1.

The appeal is allowed with costs.
The award by the arbitrator is set aside and in its place, the following is
substituted:
