l'TILITIES
I. Without prejudice to any other concessions that the Go\'crnment may agree
to grant to the Compan) by any subsequent Agreements, the Company shall enjoy for
its official communications, treatment not less favourable than that accorded by the
Government to any Govemment including diplomatic missions of s uch Government or
to any other International or African Organisation in the matter of priorities and rates
of mail , cables, telegrams, telefaxes, telephones and other communications as well as
press rates for infom1ation to press or telev ision.
2 . All offi cial communications addressed to the Company, its 1\lanaging Director,
Deputy 1\-Ianaging Director or any other official of the company and all outward
communication of the Company, shall be immune from censors hip and from any fonn
of interception or interference.
3. T he Company shaH have the right to use codes aud dispatch and receive official
correspondence, and without limitation by reason of this enumeration, publications.
documents. plans, blue-prints and sketches, still and moving pictures, fil ms and ound
recordings. either by courier or in sealed bags wruch s hall enjoy tbe same immunities.

~- 1'\othiug in trus Article shall be construed to preclude the adoption of appropriate
precautions by the Government designed to prevent or avoid abuse of the immunities,
exemptiom and privileges provided in this Article.
5. Ln consultation with the Govemment and without prejudice to other provisions
of this grcement. the Company shall install and operate such equipment as may be
necessary for the proper performance of its fu nctions.
6. Without prejudice to special concessions that might be offered by the
(iovernment to the Company by any subsequent Agreements the Company shall be
entitled, for its official purpose to use transport operated by the Govennncnt at the
rates and terms not less favourable than those accorded by the Government to any
Govcmment or any other Intemational or African organisation.
7. T he appropriate authorities of the Republic of Z imbabwe s hall exercise, to
the extent requested by the Managing Director, the powers which they possess with
respect to the s upply of public services to ensure that the offi ces of the Company shall
be supplied on equitable tenns with the necessary public services. including electricity,
water, post, telephone, telegraph, transport, drainage. collection of refuse, fire protection,
etc.
8. In case of any interruption or threatened interruption of any such serv ice, the
appropriate authorities of the Republic of Zimbabwe shall consider the needs of the
Company as being of equal importance with similar needs of essential agencies of the
Govemment , and shall take steps accordingly to ensure that the 'vork of the Company
is not prejudiced
ARTICLE 6
Af\ANCIAL PROVIS I O~S
I. Subject to exchange contmllaws and regulations fo r the time being in force,
the Company may. operate such extemal bank accounts in foreign cunencies as may
be necessary in order to satisfactOiily carry o ut its activities. rlowever, it is agreed
that prior Exchange a pproval is requi1·ed to place locally realised capital/income into
External Accounts.
