The report outlines how the Government of Zimbabwe embarked on an operation to“clean-up” its cities. It was a“crash”operation known as “Operation Murambatsvina”, referred to in this report as Operation Restore Order. It started in the Zimbabwe capital, Harare, and rapidly evolved into anationwide demolition and eviction campaign carried out bythe police and the army.

This report considers the human rights implications of the so-called fast track process of land redistribution in Zimbabwe, under which the government has revised the constitution and amended legislation in order to allow it to acquire commercial farms compulsorily and without compensation, and the land occupations that have accompanied it since early 2000.

The report contains research about violence that occurs after elections and how it is generally more violent than pre-election violence, and is mostly precipitated by the challengers.

This article assesses the effectiveness of the Tree of Life healing approach, which was one of the methodologies tried during the course of the research with a small group of survivors of the 1980s atrocities.

This is an appeal against the whole judgment of the Labour Court handed down on 20 February 2015. The respondent was employed by the appellant as an Apprentice Distribution Electrician on 17 September 1984. ZHRC’s ability to go ‘where the angels fear to tread’ impresses Speaker

This was a complaint on the arbitrary eviction and alleged violation of the complainants’ freedom from arbitrary eviction, right to dignity, the right to privacy and other interrelated rights of residents of Maganga Estate in Marondera-Mashonaland East Province (hereinafter referred to as the complainants).

This is an appeal against the whole judgment of the Labour Court which dismissed an appeal against an Arbitral award issued in the respondents’ favour. The salient facts in this matter are the following. In 1995 the appellant employed the respondents as shelf packers and they rose through the ranks.

This is an application under s 24(1) of the former Constitution for declaratory and consequential relief pursuant to the Declaration of Rights enshrined in that Constitution. The applicant in this matter is HIV positive. He started his anti-retroviral treatment in 2003. On 19 of February 2011, he was arrested at a meeting held to commemorate an AIDS activist.

ZHRC CHIREDZI ABDUCTION INVESTIGATION REPORT 2016

The applicants herein were jointly charged with the crime of criminal defamation as defined in s 96 of the Criminal Law (Codification and Reform) Act [Cap 9:23] (the Criminal Law Code). Pursuant to an application under s 24(2) of the former Constitution, the Magistrates Court sitting at Harare has referred the matter to this Court for the determination of certain constitutional questions.

The applicant and one Cecil Rhaniel Chengetai Muderede (“Muderede”) were engaged in an intimate relationship until about 2005 when the relationship came to an end. At the centre of the dispute giving rise to the present proceedings are two properties. The first is Number 4 Goodall Avenue, Emerald Hill, Harare registered in the name of Helce Enterprises (Pvt) Ltd, a company incorporated according to the laws of Zimbabwe.

This is an appeal against the decision of the High Court dismissing with costs an application filed by the appellant for the upward review of the amount of maintenance payable by the respondent in respect of the appellant and two minor children of the former matrimonial union.

The court unanimously concluded that the applications should be and are hereby dismissed with no order as to costs.

Investigative Report on Discrimination on the Basis of Political Affiliation, Kadoma (Mashonaland West) 2018

The Secretary for Justice, Legal and Parliamentary Affairs, was duly authorised to depose to this affidavit on behalf of both 1st and 2nd Respondents.

This is the final report containing the findings of the Zimbabwe Human Rights Commission (ZHRC), pursuant to a monitoring mission that was undertaken on the 17th - 18th, the 21st – 25th of January and the 11th of February 2019 in Harare Metropolitan Province, Bulawayo Metropolitan Province, Mashonaland West and Mashonaland East in the aftermath of disturbances that occurred from Monday 14 January 2019.

A complaint of alleged unlawful eviction was lodged by settlers at Yorkshire Farm in Headlands.

Zimbabwe’s acute need for justice and reconciliation highlights a longstanding tension in transitional justice practice. The need for transitional justice processes in Zimbabwe has been clear since at least 2003, when Zimbabwean civil society articulated an ambitious set of transitional justice objectives in the Johannesburg Symposium.

The applicants are all citizens of, but are not resident in, Zimbabwe. They give different reasons for their absence, with the first applicant citing political reasons.

This matter was referred to this court by a magistrate in terms of s 24 (2) of the former Constitution of Zimbabwe. After hearing the parties, judgment was reserved.

At the end of hearing argument for both parties the court dismissed the application with no order as to costs. It was indicated at the time that reasons for the decision would follow in due course.
